The words of which the initial letter is capitalized have meanings defined under the following conditions. The following definitions shall have the same meaning regardless of whether they appear in singular or in plural.

• Application refers to KVA Scholar, the software program provided by the School, which may include mobile applications for Android and iOS, and any associated web portals.
• School (referred to as either "the School", "We", "Us" or "Our" in this Agreement) refers to Kharagpur Vision Academy, Mumbai - Kolkata Highway Sadatpur, Kharagpur 721301, West Bengal, India.
• Country refers to: West Bengal, India.
• Device means any device that can access the Service such as a computer, a cellphone or a digital tablet.
• Firebase refers to the suite of services provided by Google used for backend infrastructure for Our Applications, including but not limited to databases, authentication, analytics, and push notifications.
• Location Data refers to real-time geographic location information collected from school bus GPS tracking devices, not from users' personal devices.
• Personal Data is any information that relates to an identified or identifiable individual.
• Service refers to the Application (KVA Scholar).
• Service Provider means any natural or legal person who processes the data on behalf of the School. It refers to third-party companies or individuals employed by the School to facilitate the Service, to provide the Service on behalf of the School, to perform services related to the Service or to assist the School in analyzing how the Service is used. This includes Firebase.
• Supabase refers to a suite of services that may be used for backend infrastructure, including database services, file storage, authentication, and analytics.
• Usage Data refers to data collected automatically, either generated by the use of the Service or from the Service infrastructure itself (for example, the duration of a page visit or app feature usage).
• You means the individual (student, parent, or guardian) accessing or using the Service, based on information provided by Kharagpur Vision Academy.

Personal Data

The KVA Scholar Service does not allow direct user sign-ups. Personal Data is primarily provided by Kharagpur Vision Academy from information collected during student admission and enrollment. This information is used to grant You access to the Service and its features. This may include, but is not limited to:

• First name and last name (Student and/or Parent/Guardian)
• Email address (Parent/Guardian)
• Phone number (Parent/Guardian)
• Address, State, Province, ZIP/Postal code, City (Student)
• Class and section (Student)

Usage Data

Usage Data is collected automatically when using the Service. This may include information such as Your Device's IP address, browser type, pages visited, time and date of visit, time spent on pages, unique device identifiers, and other diagnostic data.

Location Data (Bus Tracking)

The Service collects real-time Location Data from GPS units installed on school buses for the sole purpose of providing the bus tracking feature. This feature does not collect, track, or share the personal location of any user or their device. The data collected is limited to the bus's coordinates, speed, and bearing.

Information Collected while Using the Application

While using Our Application, particularly the KVA Scholar mobile app, in order to provide its features, We may request permission to access certain functions on your Device:

• Pictures and other information from your Device's camera and photo library: This permission is required for features such as teachers attaching images to notices or for users to save attached images from notices to their device. Student photographs used for identification are typically provided by the school during admission.

You can enable or disable access to this information at any time through Your Device's settings.

The School may use Personal Data for the following purposes:

• To provide and maintain our Service: including monitoring usage and distributing academic information and announcements from the School.
• To provide the Bus Tracking feature: using Location Data from school buses.
• To manage Your access: to the different functionalities of the Service available to You as an authorized user.
• For the performance of educational services: providing information and features related to the student's enrollment and academic progress.
• To contact You: by email, telephone, SMS, or push notifications regarding updates or informative communications related to the Service.
• To provide You with news and general information about school events and activities.
• To manage Your requests: to attend and manage Your requests to Us or the School.
• For other purposes: such as internal data analysis, identifying usage trends, and to evaluate and improve our Service.

We may share Your personal information in the following situations:

• With School Personnel: Student information is accessible to authorized Kharagpur Vision Academy administrators and teachers for school operations.
• With Service Providers: We may share Your personal information with Service Providers like Firebase to monitor and analyze the use of our Service, facilitate communications, and support the provision of the Service. They are obligated to protect Your data and are not permitted to use it for other purposes.
• For business transfers: We may share or transfer Your personal information in connection with any merger, sale of School assets, or acquisition.
• With Affiliates: We may share Your information with Our affiliates, who will be required to honor this Privacy Policy.
• With other users (within the school community): Certain information (e.g., student name in a class list) may be visible to other authorized users as part of the Service's intended functionality.
• With Your consent: We may disclose Your personal information for any other purpose with appropriate consent obtained by the School.

The School will retain Your Personal Data only for as long as is necessary for the purposes set out in this Privacy Policy and for the duration of the student's enrollment at the School. We will retain and use Your Personal Data to the extent necessary to comply with our legal obligations, resolve disputes, and enforce our legal agreements and policies.

Your information, including Personal Data, is processed at the School's operating offices and in other places where our Service Providers are located. This means information may be transferred to computers located outside of Your jurisdiction where data protection laws may differ. Your use of the Service represents Your agreement to that transfer. The School will take all steps reasonably necessary to ensure that Your data is treated securely.

As account information is managed by Kharagpur Vision Academy, You may update, amend, or request deletion of Your information by contacting the school administration.

Please note, however, that We (and the School) may need to retain certain information when we have a legal obligation or lawful basis to do so.

The School may be required to disclose Your Personal Data if required to do so by law or in response to valid requests by public authorities (e.g. a court or a government agency).
